אגף השיקום - וועדות רפואיות וקביעת פרופילים ! (20/1/2013)

מאחר ושאלות אלו נשאלות כאן הרבה להלן הפקודה המתייחסת לוועדות רפואיות, ערעור עליהן ובקשה לקביעת וועדה רפואית:

סמכויות ועדה רפואית

* תוקף סעיפים 8 עד 10 מה – 29 פבר' 96

8. ועדה רפואית מוסמכת לקבוע או לשנות, באופן זמני או באופן קבוע, את סעיפי הליקוי ואת הפרופיל הרפואי של החייל הנבדק על ידה, לרבות קביעה, כי החייל אינו כשר לשירות (פרופיל 21) או אינו כשר ארעית לשירות (פרופיל 24).

9. ועדה רפואית בדרג נמוך מוועדה רפואית פיקודית או חילית אינה מוסמכת לקבוע לחייל פרופיל 21 או פרופיל 24.

10. קביעת הוועדה הרפואית תועבר לבדיקת מקרפ"ר-ענף מיון רפואי, כמפורט בפ"מ 32.0402.

בדיקות חוזרות

* תוקף סעיף 11 מה - 26 אבג' 97

11. היו חייל או מלש"ב סבורים, כי הכושר הרפואי שנקבע להם על ידי ועדה רפואית או על ידי ועדה רפואית עליונה נשתנה מכל סיבה שהיא, רשאים הם לפנות לפוקד בבקשה בכתב להעמידם בפני ועדה רפואית. בבקשה זו עליהם לפרט את השינויים שחלו בכושרם הרפואי מאז נבדקו בפעם האחרונה.

הזכות לפנות בבקשה תינתן רק אם נתקיימו שני התנאים האלה:-

א. עברו לפחות שלושה חודשים מאז ניתנה ההחלטה האחרונה שקבעה את כושרו הרפואי.

ב. לבקשה צורפה תעודה רפואית מרופא מוסמך בה הוא מעיד שזיהה ובדק את המבקש ומצא שחלה או נחבל או הבריא ממחלה המפורטת בתעודה לאחר התאריך שבו נקבע לאחרונה כושרו הרפואי, וכי שינויים אלה הם, לדעת הרופא, מבחנים לדרגת כושר רפואי שונה מזו שנקבעה למבקש לאחרונה.

הפוקד הינו לצורך העניין לשכת הגיוס. חוות הדעת אינה חייבת להיות של רופא צבאי

* תוקף סעיפים 12 עד 16 מה - 29 פבר' 96

12. פניות, כאמור בסעיף 10 לעיל, יועברו לגורמים האלה:-

א. אם הפונה הינו מלש"ב - למפקד לשכת הגיוס האזורית המתאימה או לסגנו.

ב. אם הפונה הינו חייל בשירות סדיר או בשירות מילואים - למקרפ"ר-רע"ן מיון רפואי כפוקד. מוקד פרח

13. אם הגורם, כמפורט בסעיף 11 לעיל, מוצא שהבקשה אינה עונה על התנאים המפורטים בסעיף 10 לעיל - יחזיר אותה למגיש, תוך ציון נימוקיו.

14. אם הגורם, כמפורט בסעיף 11 לעיל, מוצא שהבקשה עונה על התנאים המפורטים בסעיף 10 לעיל, תועבר הבקשה לוועדה הרפואית המתאימה, והמבקש יוזמן להתייצב לבדיקות. הגורם רשאי להעביר את הבקשה לוועדה הרפואית, גם אם הוגשה בניגוד למפורט בסעיף 10 סעיף משנה א לעיל.

ערר

15. כל מלש"ב וכל חייל רשאים לערער על ההחלטה האחרונה שקבעה את כושרם הרפואי. אולם, אין זכות ערר למלש"ב או לחייל הטוענים, שמגיע להם פרופיל שונה מזה שנקבע להם על ידי הוועדה הרפואית, כל עוד אין המלש"ב או החייל טוענים, כי יש לשנות גם את ההחלטה בדבר כושרם הרפואי.

16. מלש"ב או חייל, המבקשים להשתמש בזכותם לערער על החלטה הוועדה הרפואית, יגישו את כתב הערר, בתוך שלושים ימים ממועד הבאת החלטת הוועדה הרפואית לידיעתם, לגורמים האלה:-

א. למפקד לשכת הגיוס האזורית או לסגנו כפוקד - אם הוא מלש"ב.

* תוקף סעיף משנה ב' מה - 26 אבג' 97

ב. למקרפ"ר-רע"ן מיון רפואי כפוקד - אם הוא חייל. בקשת החייל תועבר למקרפ"ר, במעטפה אטומה, ישירות דרך מפקדו האישי של החייל.

* תוקף סעיף 17 מה - 29 אבג' 97

17. בערר יפרט המבקש את המום, המחלה או המבחן המצדיקים את ערעורו ויצרף לערר תעודה מרופא, שבה מעיד הרופא, שזיהה ובדק את העורר, ומצא בו את כל המבחנים המפורטים בתעודה, שהם, לדעת הרופא, מבחנים של כושר רפואי שונה מזה שנקבע לעורר.

* תוקף סעיף 18 מה - 29 פבר' 96

18. ערר, המוגש על ידי מי שנמצא בלתי כשר לשירות, אינו טעון הנמקה ואין הכרח לצרף אליו תעודה מרופא, כאמור.
